Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “parent,” “adult account holder,” or “user”) and JM Educational Technologies Inc. (“we,” “our,” or “us”) regarding your use of the EchoLingo website, mobile applications, and related services (“Services”).

By creating an EchoLingo account, accessing the Services, or allowing a child to use the Services, you agree to these Terms. If you do not agree, please do not use EchoLingo.

EchoLingo is intended for users located in the United States.

2. Eligibility

2.1 Adults / Parents

To create an account, subscribe, or provide payment information, you must:

  • Be at least 18 years old
  • Have legal capacity to enter into a contract
  • Be the parent or legal guardian of any child using the Services under your account

2.2 Children

Children may use EchoLingo only through a profile created and managed by a parent or legal guardian. Children cannot create their own accounts.

3. Account Registration

To use the Services, you must create an account and provide:

  • Name
  • Email address
  • Phone number (optional)
  • Password
  • Valid payment method

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Ensuring that only authorized users (you and your children) access your account
  • Keeping your information accurate and up to date

You agree to notify us immediately if you suspect unauthorized account access.

4. Subscriptions & Payments

4.1 Fees

EchoLingo offers subscription-based access through:

  • Apple App Store (iOS)
  • Google Play Store (Android)
  • Stripe (web)

Subscription prices and billing frequencies are displayed at the time of purchase and may change with notice.

4.2 Billing & Renewal

Subscriptions automatically renew unless canceled through:

  • Apple App Store account settings
  • Google Play Store account settings
  • Your EchoLingo web account (for Stripe subscribers)

We do not issue refunds except where required by law or by the rules of the applicable app store marketplace.

4.3 Payment Authorization

By providing a payment method, you authorize:

  • Recurring subscription charges
  • Applicable taxes
  • Charges for any additional paid features you choose to activate

5. Parental Responsibilities & COPPA Compliance

Because EchoLingo is used by children, parents must:

  • Provide accurate information during signup
  • Manage all child profiles
  • Monitor their child’s use of the Services
  • Ensure their child uses the Services safely and appropriately
  • Review and accept our Privacy Policy, including the Children’s Privacy section

By completing a subscription payment, you provide verifiable parental consent for the collection and use of your child’s data as described in the Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use EchoLingo for unlawful, harmful, or abusive purposes
  • Reverse engineer, copy, or attempt to access or download proprietary content or source code
  • Share your account credentials with unauthorized users
  • Upload content that is inappropriate, harmful, or infringes on the rights of others
  • Attempt to disrupt or exceed the intended use of the Services
  • Use automated tools (bots, scrapers, crawlers) unless explicitly authorized

We may suspend or terminate your account for violations of these Terms.

7. Intellectual Property

All materials available through EchoLingo—including stories, illustrations, audio, software code, interface design, educational content, trademarks, logos, and branding—are the exclusive property of JM Educational Technologies Inc. or our licensors.

You receive a limited, non-transferable, non-sublicensable license to access the Services for personal, non-commercial educational use.

You may not:

  • Copy
  • Distribute
  • Modify
  • Sell
  • Publicly display
  • Reverse engineer
  • Create derivative works from

any part of the Services without our express written permission.

8. AI-Generated Content & Features

EchoLingo may use generative AI services (OpenAI, AWS, or similar providers) to support translations, audio generation, adaptive learning, or storytelling features.

  • AI-generated content may include translations, synthesized voices, interactive story responses, or personalized learning suggestions.
  • We do not transmit personal user data to these AI providers.
  • Generated content may occasionally be inaccurate or unexpected.
  • You are responsible for supervising your child’s use of these features.

We may update or expand AI-powered features at any time.

9. User-Generated Content (Profile Photos)

If you upload an optional profile photo:

  • You grant us a license to store and display it as part of the Services
  • You must own or have rights to the uploaded image
  • You may delete the image at any time through the parent account
  • The image will be removed from our systems within a reasonable period

We may remove uploaded content that violates these Terms.

10. Data & Privacy

Your use of EchoLingo is governed by our Privacy Policy, which is incorporated by reference into these Terms.

The Privacy Policy explains:

  • What data we collect
  • How we use and protect it
  • Rights available to parents
  • COPPA-compliant practices
  • Third-party service providers
  • Your choices regarding data deletion

By using EchoLingo, you acknowledge and agree to the data practices described in the Privacy Policy.

11. Termination

11.1 By You

You may cancel your subscription at any time through:

  • Apple App Store
  • Google Play Store
  • EchoLingo (for Stripe subscribers)

You may also request complete account deletion by contacting support@echolingoapp.com.

11.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Use the Services in a harmful or unlawful way
  • Engage in fraudulent payment activity
  • Misuse the platform or threaten system integrity

We may also terminate the Services entirely, with notice where feasible.

12. Disclaimers

EchoLingo is provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee that:

  • The Services will always be available or error-free
  • Content will be uninterrupted or secure
  • Learning outcomes or educational results will meet expectations

You use EchoLingo at your own discretion and risk, especially when allowing your child to access the Services.

13. Limitation of Liability

To the fullest extent permitted by law:

  • JM Educational Technologies Inc. is not liable for any indirect, incidental, consequential, special, or punitive damages.
  • Our total liability for any claim related to your use of the Services shall not exceed the amount paid in the 12 months preceding the claim.

This limitation applies regardless of the form of action (contract, tort, negligence, etc.).

Some states do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless JM Educational Technologies Inc. from any claims, damages, liabilities, and expenses arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your child’s use of the Services
  • Your breach of applicable laws

15. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles.

Any disputes must be resolved in state or federal courts located in Nevada, unless prohibited by law.

16. Changes to These Terms

We may update or modify these Terms occasionally. We will update the “Last Updated” date when changes occur.

If you continue using the Services after changes are posted, you accept the updated Terms.

Material changes affecting parental rights or child data practices will be communicated when feasible.
